Can I file as common law if my partner, who I have lived with for a year, is seperated and waiting for the finialization of the divorce?

You would have to choose whatever marital status that you have with the Canada Revenue Agency (CRA). This Canada Revenue Agency (CRA) webpage lists the different ways that you can change your marital status on their files: Update your CRA information: Change your marital status
