Do I claim common-law if my partner is not a citizen of Canada and they are here on a two year working visa?

We have been together since August 2013 and he will be extending his visa this year before it expires.

Since you have been together for a full 12 months or longer, you would qualify for claiming common law.  Because of a change in marital status, you would have to mail in your returns.
