How do I state my marital status if I am in a commonlaw relationship for over 2 years and we have a child together but I am not legally divorced from my husband?

Also should my common law spouse claim as single or as in a common law relationship

You would need to use the marital status that the CRA has on file for you. If your status has changed, then you would need to contact them and change it.
