My dad was living with me and passed away at the end of the year. He was working up until he became ill and I cannot claim his as a dependent because he made more than the amount qualified; however, I took care of him until his death and paid for his medical expenses (incl. travel/accomodation/mobility aids). Am I able to claim these on my taxes although he was not considered a dependant?
Sorry for your loss.
If your dad was 65 and over and moved in with you, he automatically qualifies as a dependant regardless of his income. As such you can claim his medical expenses (subject to his income level - ie. his medical expenses must exceed 3% of his income). (While you indicated he had income, in this scenario you should look into whether you can claim the family caregiver amount and the caregiver amount.)
If your dad was under 65 and physically or mentally infirm, he would still qualify as your dependant. Again, this is regardless of his income. As such you can still claim his medical expenses (again subject to his income level). (The foregoing comment regarding family caregiver amount and caregiver amount applies if you get a medical note indicating his infirmity.)
