Who gets to claim the kids for taxes if interim sole custody was granted in October 2018? Can a person claim their legal fees in obtaining this sole custody?

There is no tax credit for children anymore. Tuition or disability credits might apply in certain cases, where appropriate

Canada Child Benefit. Is usually paid to  the  primary caregiver, usually the female partner or former partner. Partners or former partners decide between them who reports dependant children, it cannot be both.


There is no tax for legal fees incurred to resolve child custody.
