Are there any legal issues for claiming dental work(not covered by an extended health plan) Husband was the patient but wife is claiming the expense?
Wife would like to claim the portion of dental implant work that was not covered by her extended health plan. Husband was the patient. Turbo tax suggested claim is made under wife but the dollar amount is over 5% of her income which generates a red flag for risk of possible audit. We have proof of procedure and receipts but are there any legal issues that result in her claiming the expenses when husband was the patient?

No. A spouse can claim medical expenses for the
other spouse. As long as they are legitimate, unreimbursed expenses, and you
have supporting documentation, you should be fine.
