Disability tax credit transfer for 17 year old who is now working

Hello,

My dependant is now working part time. This brought up two questions:

  1. Do we need to complete a tax return for them?
  2. How do we make sure they do not claim the disability tax credit so we can claim it instead?

All you have to do on your return is claim the disability credit. Then your parents would claim the transfer on their return. For guidance, please see our TurboTax FAQ How do I claim the Disability Tax Credit transferred from my dependant?

The parent or guardian approved on the DTC application form may claim the disability amount for their child. For more information please refer to this link: Who can claim for a dependent.

You would file a return for your dependent. If he earned less than $15,705 you will still be able to use a transfer of DTC to parent. You may still get a portion of the unused portion of his credit if he earned more than that amount.  He will get first use.
