Can someone please help me understand the Last Month Rule for HSA?

Hi, I'm trying to understand the Last Month Rule for HSA.

Within, the most-recent Publication 969, the last month rule is stated:

"Last-month rule. Under the last-month rule, if you are an eligible individual on the first day of the last month of your tax year (December 1 for most taxpayers), you are considered an eligible individual for the entire year. You are treated as having the same HDHP coverage for the entire year as you had on the first day of the last month if you didn't otherwise have coverage."

(I bolded the latter clause only for emphasis herein, it is not reflected this way in official documentation)

The final clause almost reads to me as an additional qualifier without statutory basis. Nowhere within 26 U.S. Code § 223 is it indicated that ineligibility in months prior to December is intended to be only by means of being uninsured. In fact, IRS Notice 2008-52 clearly states that "The full contribution rule applies without regard to whether the individual was an eligible individual for the entire year, had HDHP coverage for the entire year, or had disqualifying non-HDHP coverage for part of the year.".

Prior to 2017, the sentence concluded with "You are treated as having the same HDHP coverage for the entire year as you had on the first day of the last month.". Period. In 2017, it changed to “You are treated as having the same HDHP coverage for the entire year as you had on the first day of the last month, if you did not otherwise have coverage.”. And in 2019, the comma was removed, but the clause was retained (same as current version).

This is ambiguous and confusing. Unless I'm missing something, the current wording is neither in alignment with the applicable statute nor IRS Notice 2008-52. Can someone please help out? I’m really struggling with this (@Mike9241 - your responses to threads on similar topics have been insightful, and I appreciate you sharing your knowledge. Do you possibly have related insight you might be able to share?)

You charged me twice for the $20 to file my califoronia returns. Once in advance. Then second when I wanted to file. The program would not let me file unless I paid another $20. It apparently didn’t pay attention to my prior advance pmt. I paid so I could file. Please refund me $20 asap. Thank you.

My wife and I are in the middle of a transition from Cal to Oregon. I am trying to decide now whether we will/can/should file jointly or separately for 2026 so I can make some tax-related decisions.

My wife will be living and working exclusively in Oregon for 2026. She has is receiving retirement benefits from the California State Teachers Retirement System as Oregon income not Cal. She is working in Oregon.

I will be living and working exclusively in California for all of 2026.

Assume that she will have about $100k AGI (all in Oregon) and I will have about $100k in AGI (all in California)

We will have itemized deductions that are substantially greater than the standard deduction so we can both separately itemize. Those deductions include property taxes in both states (abt 20k), mortgage interest in Oregon (abt 20k and charitable contributions mostly in Oregon (abt 25k).

Must we or should we file MFS with her doing an Oregon return and me doing a Cal return?

Or can or should we file jointly for fed with individual state tax returns?

2024 amendment: changes show in TurboTax Online ($110 refund increase) but no Form 1040-X in downloaded PDF. How do I get the amendment paperwork?

Trying to amend my 2024 joint federal return (filed April 2025, accepted) to add a missed nondeductible Traditional IRA contribution for my spouse.

Steps:
1. Tax Home → 2024 return → "Amend (change) 2024 return"
2. Federal → Deductions & Credits → Traditional and Roth IRA Contributions → updated spouse's total contribution and the "Jan 1 – Apr 15, 2025" portion
3. Walked through all follow-up screens (recharacterization, basis, etc.) — left everything else unchanged
4. Top of screen correctly showed an updated Federal refund (a small increase) and a slightly lower VA tax due

Problem:
When I download the PDF from Print Center (Tools → Print Center → both 2024 Federal + Virginia → "Just my tax return(s)"):
- PDF contains Form 1040, NOT Form 1040-X
- Cover page says "Electronic Filing Instructions for your 2024 Federal Tax Return" — no mention of amendment
- AGI shown is the new amended value, but the refund line still shows the original refund amount (not the amended one)
- No Form 760 Amended for Virginia either

Never saw a File step that explicitly said "this is an amendment." The original "Filed" status from April is still showing on Tax Home.

Questions:
1. Is there a step in the amendment workflow that triggers Form 1040-X generation that I might have skipped?
2. Should I close and re-enter the amendment workflow from scratch?
3. Known TurboTax Online bug for small-dollar amendments?

Using TurboTax Online Premium. Thanks for any guidance.
