Your post has been changed because invalid HTML was found in the message body. The invalid HTML has been removed.

This post FROM nerdboyjoe is consistent with what I did at the start of this. It worked for me. BUT two additional points:

(1) for doing self and spousal returns, split the total appropriately and enter 100% for each one's share.

(2) folks with net capital losses from their T3s...work through his explanation carefully to see whether it works.

. I think I figured something out this morning from closely reading CRA's definition of error 95365 and then examining both Chart A of form T936 and Schedule 3. Here is that definition:

There are entries for capital gains on T3 information slips and one of the following situations applies to your client’s return:

Line 17600 on the Schedule 3 is greater than line 68140. There is an entry on line 68140 but no entry on line 17600. Line 68150 is greater than line 68140. There is an entry on line 68140 but no entry on line 68150.

If that definition is up to date and CRA's Netfile validation code is actually following it precisely, then I see a problem with the validation code. The problem is, there is no mention of Line 17599 in that definition. Why does that matter?

If you look beside line 68140 in Chart A of form T936, it says "Enter the amount from box 21 of all 2024 T3 slips". Box 21 is the sum of boxes 52 and 53 on the T3. However, on schedule 3, boxes 52 and 53 are not summed into box 17600. Rather, the sum of all boxes 52 go into line 17599 and the sum of all boxes 53 go into line 17600.

That means the validation check is comparing apples with oranges. Specifically, line 68140 includes amounts from both boxes 52 and 53 whereas box 17600 includes amounts only from box 53. Note that as per point #1 of the error 95365 definition above, box 17600 and 68140 do not have to be equal. Rather line 17600 should not be greater than line 68140. That's why the rule passes for some people (like me) but not others (like the people who said they have some negative amounts in some of the box 52 and/or 53 entries).

I believe that both WealthSimple and TurboTax would be susceptible to this CRA bug. However, the problem can be expected to be more prevalent with TurboTax if you are splitting your T3's with your spouse. That's because the current version (as of today, April 2) of TurboTax is not splitting the capital gains amount between spouses, whereas WealthSimple is splitting it correctly (yes, I checked this). If you are single, or not splitting T3's with your spouse, then I would expect that the prevalence of error 95365 would be equal in both software applications.

To workaround the issue with CRA's validation not taking into account line 17599, one possible one that I can think of is to put the sum of box 52 and box 53 into box 53 and clear out box 52 on all your T3 slips, and make sure that it equals what is in box 21. The distinction between box 52 and 53 is now irrelevant because the government rolled back the change that would have made that distinction matter (Google that if you want to fact check it).

After doing the workaround but before you attempt another Netfile, make sure you closely examine the lines mentioned in the definition of error 95365 to make sure the rules are now being satisfied 100%. If not, then retrace your steps and try again. Read the definition closely!

I hope this helps.

It says I reported capital from a T3 slip on Line 17600 of Schedule 3. An entry is also required on Line 68140 in Chart A of form T936. line 68140 cannot not be less than line 17600

I don't understand is all the numbers are automatically generated. What caused the error?

Can someone help?

Line 68140 in Form T936, Chart A should automatically include the sum of all lines 21 in T3 slips. It's not working. I called Turbotax customer support twice yesterday and today. The staff I discussed this with had no idea, made excuses, said that it's a problem with CRA, etc. No resolution so far.

Hope someone will see this and fix it, it's an error in the desktop version. CRA rejected my tax return.

Try calling them, if more people call and post about this they may react.

I've used Turbotax for 21 consecutive years, this is the last time. Their lack of response is shocking, I don't trust this company with my numbers anymore.

Thanks for the advice about Premier Edition but I have been using Standard for 15 years and have never had a problem with T3 entries. For some reason the TurboTax program is not entering the number from the T3 slip (ie. total of Box 21) into the T936 form. It successfully enters the number into the Schedule 3 but failed to enter the same number into the T936 form. When I checked the 2023 tax form all numbers were entered successfully into the T936. I am not able to override the entry. This is a TurboTax issue not a CRA issue. I hope that the TurboTax team can get this resolved.

Completely agree...this sure looks like a TurboTax issue with data not populating from the entry screen for T3 to the T936. This is pretty clearly a TurboTax that has to be fixed in order to NetFile returns. Hopefully the next TurboTax update will have the correction done or have the purchase price of the program refunded to all users with this issue.

I am having the same issue. #95365- there is an entry on form T936 and /or on the Schedule 3. Reported a capital gain from a T3 on line 17600 of schedule 3. An entry is also required on line 68140 in chart A of form T936. Line 68140 cannot be less than line 17600. Plus 3 other points.

I called and same thing they told me it was a problem with CRA, I don't agree. I think it's a problem with thier software.

She also told me to try again yesterday evening and that it was a known issue that CTA is working on. I ended up trying again this morning and same thing. I really don't want to be locked out of Netfile and need to talk to CRA for a couple hours to correct it.

It doesn't sound to me like the person I talked to had a clue!

from an AI search relating to this issue...

The Canada Revenue Agency (CRA) is generally aware of issues affecting NETFILE submissions, but specific awareness of the error code 95365 related to Line 17600 and Form T936 is not explicitly confirmed by the CRA in the provided search results. However, users have reported similar issues with tax software, suggesting that the problem may be more related to software errors rather than a CRA system issue.

Software Issues: Many users have experienced errors with tax software, such as TurboTax, where Line 68140 in Form T936 does not automatically populate correctly, leading to errors like code 95365. This suggests that the issue might be with the software rather than the CRA's NETFILE system.

CRA Response: While the CRA may not have directly addressed this specific error in the search results, they typically provide guidance on resolving errors through their website and customer support. Users have reported that after contacting the CRA, their NETFILE accounts were unlocked, and they were able to resubmit their returns successfully.

NETFILE Lockouts: If you encounter multiple failed submissions, your NETFILE account may be locked, requiring you to contact the CRA to unlock it. This is a standard security measure to prevent excessive attempts.

In summary, while the CRA is likely aware of general issues affecting NETFILE submissions, the specific error code 95365 seems to be more related to software glitches rather than a CRA system problem. Users are advised to contact their tax software providers or the CRA for assistance.

Thank you, the only reason I'm unable to file is this issue. I'm expecting a sizeable refund, the money could be in my account making interest, but it's not there as I'm waiting for Turbotax to fix their product. Hope you find a solution soon. Just checked and nothing, no update. It's been four days since I reported this issue.

Thank you.
