    <description>&lt;P&gt;I had the exact same error (95365) when filing. The issue seems to be that when Turbotax fills in the data on form T961, it does not respect the sharing with spouse and includes 100% of the capital gains not 50%. (It probably also does not record the other 50% on the spouse's return.) So CRA says you are trying to claim more capital gains on that form that on you are in Schedule 3 which is your 50% share. So it rejects the Netfile. There is no way to override this on the T961 form. The only way to fix it is to go with 100% on the spouse that is recording the capital gain.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Very annoying. There have been so many issues with this year's version of the product that I am considering going a different route next year!&lt;/P&gt;</description>

      <description>&lt;P&gt;&lt;SPAN&gt;I recently received aT3 with a Capital Gain of $200 in Box 21 and $600 of Other Income in Box 26.&amp;nbsp; The Box 52/53 capital gain split was $150 and $50.&amp;nbsp; This T3 is a joint account and so I set my % to 50% for me and 50% for my spouse.&amp;nbsp; When I updated the T3 input&amp;nbsp;form under my name, my taxable capital gains increased by $100 while my spouse's taxable capital gain remained unchanged.&amp;nbsp; The Other Income was split 50/50 on our individual tax returns which is correct.&amp;nbsp; The taxable capital gains should have increased by $50 on both returns not $100 on my return.&amp;nbsp; So something is not right and I suspect the 50% is not being applied to the entries in Boxes 52 and 53.&lt;/SPAN&gt;&lt;/P&gt;</description>

      <description>&lt;P&gt;I only noticed the error when I compared the comparison summary for both spouses. Didn't understand why Taxable Cap Gains were attributed to one spouse only, even though I specified a split in the T3 data entry. I had to work backwards then make individual T3 entries for each spouse, with manual calculation for all T3 boxes based on % distribution for each spouse. Boxes 52 and 53 don't appear to be linked to the split percentages.&lt;/P&gt;</description>

      <description>&lt;P&gt;While we wait for the desktop version to be fixed, just create 2 T3 entries, one for each person, each at 100% split and halve the numbers in the boxes. This gave me the correct result for the tax return.&lt;/P&gt;</description>

      <description>&lt;P&gt;I have the same issue but I missed it when filing our returns.&amp;nbsp; We had a T3 that was to be split 50/50. My spouses tax return was processed with CRA without issue but it had an unnoticed error (no capital gains&amp;nbsp; were carried forward in error from the T3 when there should have been 50%).&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;My tax return was not processed&amp;nbsp; and came back with a CRA error message code #95365.&amp;nbsp; So I called CRA and when we did a walk through it was then I noticed my spouse did not record a capital gain (all other boxes on the T3 were split 50/50 correctly (interest, other income - except the capital gains!!!)).&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;So, now I have to force the figures for me to claim 100%? It is a small amount but how do I ensure I entered all the boxes properly. THANKS TURBO TAX!&amp;nbsp;&amp;nbsp;&lt;/P&gt;</description>
