So I have a bit of an update for everyone after calling Turbo Tax to ask for a refund:

 

I was told that a fix was applied 2 days ago (to the online version, she was unaware why people are reporting no updates to the desktop) and I should now be able to file.  I informed them that this is news to everyone on this forum, including the Turbo Tax Administrator.

 

When I explained that my tax returns were already filed with incorrect data for my own and for my spouse using the Turbo Tax recommended work around of splitting the T3 data manually  (mine was accepted by Netfile with the Capital Gains figures from the T3 incorrectly transferred to my return, and I only discovered this after my spouse's return generated the Netfile error), and that my NOA was still pending, I was told that there was nothing that they could do and to contact the CRA to adjust the return with them so that they'd issue a NOA.  When I asked what Turbo Tax was going to do to compensate clients, she explained that because I didn't pay for the additional Turbo Tax review, they are not responsible and won't refund me or provide any credit for their software being buggy.  She said that because I only paid for the software to help prepare the return, it was on me to check the figures and identify the faulty software.  I mean WOW, what a take on this whole issue!

 

It truly is mind blowing logic being applied here, just a complete fail all around!  A defective product has been been compounded by how they've handled it.  At this point, I view the $140 spent as an investment to find out what a dumpster fire this company has become.  I count myself lucky that the issue wasn't any more serious than a minor discrepancy in numbers that will eventually be rectified.  What is important is that I now know to stay as far away from Intuit products as possible.  Buyer beware, good luck everyone.

Here's my workaround for my 'Error 95365' blocked spousal return - change the T3 capital gains portion to 100% for my spouse (it was formerly at 50% split).

 

This had a negligible change to the refund amount; is possible it will generate an query from CRA; but finally put an end to the frustration of waiting on the utter incompetence from Turbotax - it allowed me to finally finish filing.

 

This might not work for everyone, but our Capital Gains portion was so relatively minuscule (under $100), it is not worth my time to hope in vain day after day for a Turbotax fix they don't even seem to realize is needed for the desktop version of their software!

FYI i'm using the online version.

 

I just tried to resubmit my return that was having a problem all this time and it failed again while the return of my wife was submitted on March 20 successfully from the first time however was not able to get NoA up until this morning (11 days).

 

keep in mind that all my capital gain from T3 have been claimed by my wife 100% and 0% by me.

 

although my original error was that line 52+53 doesn't equal line 21. that was corrected a week or so ago, i'm currently still have problems submitted netfile my return with error 95365 as the OP.

 

now i already got my netfile blocked once and had to remove the restriction after trying to get a hold of CRA for 2 days and now i'm already on try # 2 out of 5.

I should explain my situation.  I did 3 returns.  The first 2 went through fully and the third had this error 95365.  The third tax filing was my spouse.  There is no splitting of income from T3's in our case.   The only difference is that my spouse had a capital loss this year while the other 2 tax returns prepared did not. 

 

Not sure if this is of any help.

Code #95365  Work Around:  Here’s what I did to successfully netfile our returns: (I'm using desk top version - Standard)

  1. Use forms method.  2. Click on T-Slips and change any “split” T3’s to 100%.  3. Manually divide all amounts in half.  4. Change box 52 and 53 so that total of both shows up in box 53 (re: after June 25th) The amount in box 53 should equal box 21.  5. Using forms method, enter a new T3 for your spouse for their share using the same method splitting the entries.  6. Open Schedule 3 and check line 17600 and then open form T936 and check line 68140.  These amounts should be the same.  If not, don’t bother trying to netfile. 

 

This workaround worked for me as I had larger capital gains than losses.  I still can’t file for my friend who had larger capital losses than gains.  I’ll have to wait for a software update on that or print/mail.

 

I printed out the TurboTax confirmation, however now that I don’t trust it fully, I logged into my CRA account.  On your home page over to the right you will find confirmation that they have received your return – print it out!  Who knows… you just might need it if your return disappears into cyberspace!

 

So hopefully this doesn’t cause delays with CRA getting me my refund.  If it’s a minor refund amount you might want to wait for an official software update.  Will it trigger an enquiry from CRA?   – it might so make notes on exactly what you did in case you have to explain it to them at a later date.
