I have medical expenses from the last 3 tax years that we were unable to claim because my spouse made too much. Now that we make less, can we claim those years now?

CRA allows you to use any 12-month period of expenses that is most advantageous to your situation, provided it ends in the tax year. You cannot claim a medical expense this year that you have claimed in the previous returns. You have to use the same start and end date for all members in the family. This allows you to claim those medical expenses you couldn’t claim last year, as long as the last date ends in the tax year.

 

For example, the oldest medical expense that you can claim on your 2021 return is an expense from January 2, 2020, using a claim period of January 2, 2020, to January 1, 2021.

 

Please Note:

You can use a different 12-month period each year--the period doesn’t have to start where your previous 12-month period ended. However, you can't claim the same expenses more than once.
