My son's wife has a daughter from a previous marriage and was claiming her on her income tax. They were married in 2014 so does he need to claim the daughter if they do a combined income tax return? Or can they both file separate returns whereas she claims her daughter and he will claim no dependents?
They are living together. Whether they are married or common-law, they are filing indicating their marital status. They can not claim as single taxpayers, and your daughter in law will not be able to claim the Eligible Dependant credit.
