Can i deduct child care expense paid using RL24 if spouse is not working?

The warnings section is telling me that the "The contribution set by the government that you paid for childcare services is not considered an eligible child care expense on your Québec return." 

I am currently unemployed, so I can't claim these expenses on my federal return. But can my husband claim these expenses on his QC return?
