Yup. I absolutely expected that this update would not fix error 95365 for most (if not all) people with capital losses. CRA still needs to do a fix on their end for this scenario. I feel pretty confident in saying that. See some of my earlier posts from today and yesterday about this. But at least TurboTax did fix the spousal splitting of capital gains issue. That's an improvement. However, the update process was more clunky than usual.

T936 is not being updated for me - so it is still a turbotax issue.  I am not even at the point of attempting a netfile to see it fail with the CRA.

Turbotax has to fix it so that the proper fields are being udpated.

Yes, there is no point trying to resubmit it using NETFILE if the line 68140 is still empty.

Finally success.  I was able to submit both of our returns through NetFile after fully reinstalling TurboTax since the Update would not load.  That fixed the incorrect lines so no more error code #95365.

For people with only capital gains, the following procedure might allow you to Netfile with today's updated version of TurboTax Desktop:

  1. Download the latest version of TurboTax Desktop from here: https://turbotax.intuit.ca/tax/software/download
  2. Uninstall current version.
  3. Install new version.
  4. Make sure the About Box shows the following version (or even later version if you are reading this a few days from how): Version 00.01.62 Build 6007 068G25
  5. Open both spouses' returns and examine line 17600 on Schedule 3 and Lines 68140 and 68150 in Chart A of form T936. Make sure that all of the following conditions from the definition of error 95365 pass do not exist anymore. error 95365 definition.png
  6. Spin around 3 times and shake salt (pink Himalayan salt...very important!) over your left shoulder.
  7. Cross your fingers.
  8. Netfile, baby!

It is now April 3, has anyone been given an answer how to fix this error?

I'm wondering what the downside is of simply printing theT1 and mailing it if not able to Netflix?  Does this result in a long wait time for a refund (which is substantial)?  I have a net capital loss and I've loss confidence that this will be fixed by Turbo Tax any time soon.

Did you use as Ufile as well?  I am ready to trash Turbotax and buy Ufile.
