Yes but it says 'if you meet all of the other conditions above' and one of the conditions is that your family income is less than $65,000. The way its worded, it sounds like the family income must still be below $65,000 to claim, you just don't include the spouses income which allow a higher claim if the person died before Dec 31, 2025.
So - i agree the spouses income should not be included as he died in July 2025. However, their Family income was much greater than $65,000 so is it still claimable when I have not met 'if you meet all of the other conditions above."
