My numbers are evenly split and it wont netfile. My wifes netfiled without error and everything is 50/50 so why does one work and not the other??  I called CRA today and after 1hour they said there was nothing wrong with my return and they could not find a solution.  They have passed my issue up to the IT support to investigate why it is producing the 95365 error, when the conditions for the error are not met.

I have 66/34 split on T3 between me and my spouse. When I look at the forms, row 68140 in T936 is calculated correctly for me, but it is zero on my spouses return.

In schedule 3, rows 17599 and 17600 of my return, turbo tax did not calculate the split, it gave me the total amount, which is not correct. My spouses schedule 3 rows 17599 and 17600 are zero.

So,  my return got rejected because schedule 3 capital gains do not match T936 capital gains.

The capital gains in schedule 3 is the total of rows 17599 and 17600, error 95365 does not state this.

 

i bet if you look at your wife’s Schedule 3 row 17599 and 17600, they are both zero. And further, you wife will not have a T936, because the turbotax software did not allocate her 50% of the T3 capital gains.

 

there are a many problems with the T3 processing which is why I’m waiting for the update  was told was coming on April 8

I'm seeing the exact same results as of April 2nd @ 11:00 MST...

 

Its very disappointing to see this issue has gone unresolved for so long given it affects so many users...  not a positive reflection on Intuit...

Error 95365 has been resolved. A fix for this issue will be released near the end of the next week. To ensure your version of the software is up to date, be sure to sign out of the TurboTax program, and accept all updates upon signing back in. Then start at the Review section of the return, and address all warning and error messages you may have before proceeding to NETFILE. April 9th is OK with me, but that might be because both my wife and I own CRA money this year, rather than being in the usual position of expecting a refund....  😀

My post in this thread from a couple of hours ago has magically disappeared. Too bad. It had a new and very detailed explanation of why some users are getting the error 95365 and others are not. CRA is partly to blame (for not including line 17599 in its validation of the rule as defined here) and TurboTax is partly to blame (for not splitting capital gains between spouses). It even had an easy workaround to get around CRA's part of the blame. I can only assume that a moderator perhaps deleted my post for some unknown reason. There was no profanity or false information in my post. I'm not going to bother retyping it in now because it was several paragraphs long and took me over 30 minutes to enter this morning. Rather, I'll just let the complaints keep adding up in this thread.
