The term mental or physical infirmity is not specifically defined. However, for a person (child) to be dependent on an individual (parent, caregiver) because of mental or physical infirmity, the dependency must be brought about solely because of the infirmity, and it must be severe enough that it requires the person to be dependent on the individual for a considerable period of time. Temporary illness or injury is not considered to be an infirmity for tax credit purposes.
If you have a signed T2201 Disability Tax Credit Certificate on file at the CRA for your child or a note signed by a medical practitioner that provides details about the infirmity, that is generally enough to prove eligibility for credits/deductions like the child care expense deduction.
