Hi, I am canadian working in the US and married to US citizen. I have only been to Canada for 1 week in the past year and have no significant ties to Canada other than holding passport. I guess I am considered non-resident for tax purposes? Is that correct? Do I need to do anything to report my non-resident status or I guess it will be evident based on my enter and exit at the border?
Another question is, if I say married it asks for my husband's SIN but he is not Canadian and does not have SIN. What do I do? change to Single for tax purpose? tnx
If you have lived in Canada for less than 183 days in a year and do not have significant residential ties in Canada then you are considered as a Non-resident. You are a resident of Canada and you leave temporarily for work, school, a medical procedure, or vacation, You will be considered as a Factual Resident.
Please check this link from CRA: Who Should File a Tax
You would need to show your stats as married but can file a return for yourself only. We will also recommend contacting CRA directly to get more clarification on this.
Thanks for choosing TurboTax.
