If you are in a common-law relationship as per CRA;
"Living common-law" means you are living with a person who is not your spouse, but with whom you have a conjugal relationship, and to whom at least one of the following situations applies:

In this definition, 12 continuous months includes any period you were separated for less than 90 days because of a breakdown in the relationship.
You can choose to file both of your returns as a joint/coupled return or do them separately but you must still claim that you are common-law. When you start your return TurboTax will ask you your marital status and enter Common-Law, and continue to answer the questions asked.
