My wife and I have an 80 / 20 split on a few capital gains and the updated software worked fine this time. The filing worked seamlessly. I did check that the Schedule 3 and T936 forms were properly in sync and the fields were properly entered first. I am not sure what would have happened if I had a capital loss. It is frustrating since you can only afford 5 attempts with Revenue Canada after which you need to send in a printed copy.
As it was said previously, we are aware of this issue, and we have an ongoing investigation about this. As this is an error message between Tax software's and CRA system, our team is working in collaboration with them to resolve this issue as soon as possible.

We were able to file both of our returns on Friday and within 24 hours the returns were assessed so no issues. However, we both had capital gains so I don't know if one has a capital loss what will happen.

I would recommend that Intuit update the pages where it says Netfile error code 95365 has been fixed. As far as I can tell, it has been fixed for the rounding error, but not for people who have a capital loss. Can you please let us know if the capital loss issue is even being looked into (either by Intuit or CRA)?
